What is the DBE program?<\/strong>
The New York State Department of Transportation (NYSDOT) is a recipient of federal funds and therefore, must adhere to\u00a0Title 49-Transportation, Code of Federal Regulations.<\/a> \u00a0The regulations require NYSDOT to administer the DBE Program on all federally funded highway construction contracts.<\/p>\n

Who Regulates the Program?<\/strong>
NYSDOT receives funding from three separate federal agencies:<\/p>\n

      The Federal Highway Administration (FHWA)<\/a> \u00a0has oversight responsibility on all highway and bridge construction contracts that utilize federal assistance.<\/p>\n

      The Federal Transit Administration (FTA)<\/a> \u00a0has oversight responsibility on all local public transit contracts that utilize federal assistance.<\/p>\n

      The Federal Aviation Administration (FAA)<\/a> \u00a0has oversight responsibility on all air transportation related contracts that utilize federal assistance.<\/p>\n

      NYSDOT DBE Policy:<\/strong>
      It is the\u00a0      policy<\/a> \u00a0of NYSDOT to ensure nondiscrimination on the basis of race, color, sex or national origin in the award and administration of the USDOT assisted contracts. It is the intention of NYSDOT is to create an equitable environment in which DBEs can compete fairly for contracts and subcontracts relating to the procurement, contracting and professional service activities of USDOT assisted work.<\/p>\n

      Federal vs. State Programs:<\/strong>
      The Federal DBE program is a separate program and subject to different requirements than the New York State Minority Business Enterprise (MBE) and Women-owned Business Enterprise Program (WBE). The DBE program promotes the use of DBEs in all types of federally-assisted contracts and procurement activities and does not apply to 100% state funded contracts.
